SimplyGo and SimplyGo Mini Warranty

Limited Warranty

Respironics Colorado, Inc. (“RCO”) provides this non-transferable, limited warranty for the SimplyGo (“SG”) and SimplyGo Mini (“SGM”) Portable Oxygen Concentrator Systems (collectively the “Products”) to the customer who originally purchased a SGM or SG directly from RCO.

What this Warranty Covers: RCO warrants each new Product against defects in materials and workmanship under normal and proper use and maintenance in accordance with applicable instructions, subject to the exclusions below.

How Long does this Warranty Last: Either two years (for the SG) or three years (for the SGM) from the date of shipment to the original purchaser, or (b) the warranty period purchased with the device, except:

  • The warranty period for the sieve bed assembly is one year (for the SGM) and two years (for the SG) from the date of shipment to the original purchaser or the warranty period purchased with the device.
  • The warranty period for the battery in the Products one year from the date of shipment by RCO to the original purchaser. This warranty does not apply to batteries that are dropped, misused, altered or otherwise damaged after they are shipped.
  • The warranty period for accessories, replacement parts, and disposables including, but not limited to, filters, fuses, cannulas, tubing, shoulder bag and strap, accessory bag, AC charger, and DC charger is 90 days from the date of shipment to the original purchaser.

What this Warranty does not cover: This warranty does not cover damage or injury whether to the Products, personal property, or persons caused by accident, misuse, abuse, negligence damage caused by repair or alteration by anyone other than RCO or its authorized service center, failure to operate under conditions of normal use and in accordance with the terms of the operating manual and instructions, or lack of reasonable care.

What RCO will do: If a Product does not meet the limited warranty above in the first 90 days after the original shipment date, RCO will replace the device with a new Product. Thereafter, if a Product fails to conform to the warranties set forth above during the applicable warranty period, RCO will repair or replace the Product or refund the original purchase price, in RCO’s sole discretion. RCO may use new or remanufactured assemblies, components, and parts in repair and new or recertified refurbished devices for replacement. The balance of the original warranty period will apply to any Product, sieve bed, or battery repaired or replaced under this warranty. RCO will arrange for pay the cost of standard shipping of the Product back to RCO and return to the customer for all warranty claims, provided customer follows RCO’s shipping instructions.

Additional Gold and Platinum Package Lifetime Warranty for the Products: If a Gold or Platinum lifetime warranty package is purchased with a Product, these additional warranty terms apply: (a) the warranty period is extended to the lifetime of the original user of the Product subject to the same exceptions as above, except that the sieve bed will be warranted for the lifetime of the original user; and (b) if the Product fails to conform with this warranty, RCO will replace the Product with a recertified refurbished device versus repairing the original device. If a Platinum Warranty is purchased, these additional warranties apply: (a) all replacement recertified refurbished devices will include a new battery with a one-year warranty, and accessories to replace those purchased with the original Product with a 90-day warranty; and (b) the original purchaser will have the option of receiving a new battery every two years commencing 12 months after receiving their most current device. If RCO is offering a trade-up program for the SGM to a SG, and if customer purchased either lifetime warranty with the SGM, then the same lifetime warranty will transfer to the trade-up SG.

Warranty Disclaimer; Limitation of Liability: EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, RCO MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE, REGARDING THE PRODUCT, ITS QUALITY OR PERFORMANCE. RCO SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL RCO’S MAXIMUM LIABILITY UNDER THESE WARRANTIES EXCEED THE ORIGINAL PURCHASE PRICE OR WILL RCO BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. Repair, replacement, or return of purchase price by RCO is the original purchaser’s sole and exclusive remedy under this warranty.
